i was arrested and now i feel like my life is over, serious question.?

I was 17 and i live in the UK last year i slept with a girl at a party (obviously not knowing what she was actually like) then a few days after she got me arrested for rape (obviously it wasnt like that, shes a nut case!), i got held in a cell and had finger prints and photos done all within about 12 hours, i then got let off on bail. when the bail date came it all came to an end and the bail got cancelled due to "insufficent evidence" which made me feel even worse. Now a few months on i just keep thinking about it. and i feel really insecure again and just not in control of my thoughts. so i have a few questions.

Is there a chance i can get this whole thing erased from a record?

will it show on a crb check?

becasue i was and she was 17 does that make anything different?

can i live or spend a sufficent amount of time in other countries like america? or travell?

i am just becoming very paranoid and upset about it, this girl has caused me more trouble then anything ever before. i was not charged or convicted.

    As there was no court case, you have not been found guilty of any crime. So, no you won't be on a criminal record. Tho your finger prints and DNA maybe held for a number of years. But then these are taken from everyone arrested.

    You do not say which area you live in, this might have some bearing on your chances of what I am going to say next.

    The Police are now virtually encouraged by the UK Govt legislation to arrest anybody where they have the slightest justification for doing so. This is a shame and wrong as arrest should be a last resort and where people are available for interviews and no reason to believe they will flee there is seldom justification. The reasoning is because when a person is arrested the Police are entitled to take DNA samples and they will keep them regardless of you being, charged or if charged found not guilty. So by stealth a large DNA data base is being built up of us all. Yes I know DNA records can be useful but the retention from innocent people can only be argued on the basis you are bound to do something eventually and it'll be easier to get you. However that is another subject.

    The European Courts have ruled this DNA innocent person retention unlawful. The UK Govt is so far refusing to abide by the Courts ruling. The UK Govt is stalling and has just finished a consultation process trying to find some acceptable retention time limits and circumstances to keep as much of the DNA data base as possible. That doesn't alter the illegality of the present retention. Some, not all Police Forces are abiding by the law and if you ask they will remove all DNA of innocent people. Personally for a sexual related matter I have to be realistic and think you may have little chance of them willing removing your DNA . wrong I know. You may recall that a MP had his removed after the Police searched and arrested him improperly in the House of Commons but he was higher profile than you will ever be. The situation is different in Scotland where an innocent persons DNA is removed.

    You could try contacted a local solicitor, some give a free advice session, ask them. Try a law advice centre if there is a free one near you. Ask at your local library for details. You could even try a web search for various civil liberties groups.

    I have experience of this myself.

    The other people are correct - you were not convicted of anything and therefore will not have a criminal record.

    HOWEVER, there are 3 types of criminal checks when you seek employment.

    Basic, standard and enhanced disclosure.

    Basic looks at unspent convictions

    Standard looks at unspent/spent convictions

    Its the enhanced that may cause you problems - as this looks at all other information the police and other agencies have on you. So your arrest for a sexual offence will show here. This is likely to rule you out of jobs working with children and vulnerable people for public agencies such as the police.

    Its important to note that only certain companies can apply for enhanced disclosure where your often the sole person in charge of vulnerable adults and children.

    This will not be something you have to declare when asked if you have a criminal record, unless it asks whether you have ever been arrested.

    The sad fact is there will be a number of people who will not get the employment that want or deserve. However the safe measures are there to protect the wider public and this mus be seen in perspective.

    May I suggest you apply for the information the police hold on you? The police have two databases, Police national computer (PNC) and one that's intelligence based e.g. Crimint for the met (wikipedia).

    You can do this under the data protection act and it will cost you £10. They will supply all information within 40 days. Its important to read the "subject access form" correctly as there will be a place where you request all information that they hold that's NOT on your criminal record.

    ye, u cud get it erased from a record, coz,as the cops found out,no1 had any hard evidence 2 convict u.

    no,it shouldn't show up on a crb,coz,like i sed, no1 had any hard evidence, so u didn't get convicted so u didn't have any record 2 show 4 it.

    as 4 ur age,being both 17 shouldn't make any difference coz,for one, u r both not underage and any thing.

    u should b able 2 go 2 other countries coz u shouldn't have a conviction on a record so they cant stop u from entering their country coz nobody's got anything against u(apart from that girl but,as has been established, she couldn't do any thing against u).

    You never mentioned if the girl was arrested for making such a serious allegation against you. If she had totally made it up about you she should be arrested and charged. People like her cause genuine cases to go unreported for fear of not being believed.. Why should she be able to cause such trouble for you and it have no consequences on herself. She shouldn't be allowed to get away with it.

    You do not have a criminal conviction. You have not received a formal warning. There will be a record of the arrest and outcome on PNC and the police will have it on their 'files'. It does not affect you in any way, unless you are alleged to have raped someone else in the future. Relax.

    There is nothing to erase! You will not have a criminal record, as there was no prosecution, and more importantly, no conviction.

    You might, however, like to consider why you slept with girl at a party, when possibly, she was hoping that you might have stayed awake, and allowed her to enjoy your company.

    You don't have anything on your record, that only occurs if you are found guilty in a court of law.

    If there is no prosecution, or caution given for an offence, you won't have a criminal record.
