Army Discharge chapter 14?
My friend husband is getting discharge from the army( he's getting a chapter 14 (12c)... my question they told him that he can rejoin the army in 6 months or the nation guard... what is the likely would that he will be able to do so? and does it depend on what his dd214 say? and if it does.. does anyone know what code should he be looking for?
I forgot to say that this is his first time ever getting into trouble

Obviously your friend is listenen too much to his barracks lawyers (aka his friends) and not listening to his real attorney (from the trial defense office).
Even back in the day, people who get Ch 14-12c weren't allowed waivers. Getting a 14-12c is just one level below getting kicked out via a courts-martial. The actual title for his chapter is for "serious misconduct". The army has spend significant resources to rehabilitate him and he has continued to get into big trougle. To get his chapter, he has been in a lot of trouble.
He should be spending his time worried about getting a civilian job, which will be difficult even in the best of times.

Depends on what specifically you were discharged for under chapter 14. In many cases you can be denied all benefits.

I highly doubt he will be able to come back in at all Chapter 14-12c (Serious Misconduct). More than likely it will be a RE 4.
NG used to take RE 4 on a case by case basis. However the military isn't hurting for people. Plus he is prior service.

here's a little secret: that whole : you can re up in six months: ploy is exactly that: a ploy to get you to go quiekly.
what they negelct to tell you is that will require a waiver.. that has a 98% chance of being DENIED . if he gets an RE4m, he will NEVER be permitted to re enlist. ever.
if he gets an RE3, he needs that waiver..and currentl;y, NO waivers are authorized for Prior service. and with the economy the way it is and recruitng and retention numbers so high, he can expect that it will stay that way a very very long time. years, not months.

If he has a RE code of 3 or below, he can get back in with a waiver (or without one if it's a 1).
What's his discharge type? RE 3 with "under honorable conditions" or "honorable" is possible to get back in with a waiver. RE 4 and anything "other than honorable" or below means it would take an act of God to get him back in.
