If you are in default on your mortgage the last thing you have to worry about is paying your HOA dues. If you stop paying the HOA fee, the Association will notify you and then place a lien on your property to recover the dues from either you or the next owner. In extreme cases, the Association can file a lawsuit to sell your property for the amount of the dues. What do you care? You're leaving, right? In either a foreclosure or short sale your credit rating is going to take a bad hit. Your primary concern should be finding a rental before you have a foreclosure on your credit record. While you're looking for an apartment, find a lawyer or licensed real estate agent that specializes in foreclosures or short sales. This sounds harsh and uncaring but times are tough and you have to look out for yourself first.

Suggest that you check with a realator or a lawyer that specializes in rentals and ask them what your options are. Go back and read the paperwork you signed when you moved in.

Keep it the HOA will have to put a lean on the property so you are safe they can't do squat
