There is no air force or space program specified in the Constitution either but Congress is authorized by the Constitution to make the laws. Congress has a great deal of power under the "Necessary and Proper" clause. The Commerce Clause has been interpreted very broadly in the past and Congress' actions pursuant to that clause have withstood constitutional challenge. The proposed legislative effort is to effectively reform health care in this country and provide coverage for all Americans. Congress' current efforts are a step in that direction.

The direct challenges to our fundamental freedoms and to our constitutional protections that were contained in the Patriot Act seem to have been overlooked by many of the same people who are now complaining bitterly, and with much less if any cause, about the effort to extend health care coverage. Congress was elected by the people to legislate on their behalf. The only thing unconstitutional is the filibuster option I would argue.
