Where in the Constitution does it show that Congress has a Constitutional obligation to legislate?

Health Care?

The Commerce Clause does not give Congress the Right to order (mandate,dictate) every American to have health insurance...Nor does anything else found within the Constitution give Congress this power...

What happened to freedom of choice in America, since the Democratic/Progressive/Liberal Led Congress take over in 2006 choices are disappearing one by one...

It would appear from all things being done at current times the Constitution is being disregarded, and a new form of Government is being formed: Totalitarianism

Definition of Totalitarianism - a form of government that subordinates all aspects of its citizens' lives to the authority of the state (the state being the Federal Democratic/Progressive/Liberal Led Government), with a single charismatic leader (Obama) as the ultimate authority.

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

Necessary and Proper Clause – The "necessary and proper" clause is the other clause the central government uses to grant themselves power. This clause is found in the last paragraph: key word here is: themselves!!!!!!!!! not the People...or the States

(last paragraph) To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.

It still does not give Congress the Authority over Individual Choice....

    There is no air force or space program specified in the Constitution either but Congress is authorized by the Constitution to make the laws. Congress has a great deal of power under the "Necessary and Proper" clause. The Commerce Clause has been interpreted very broadly in the past and Congress' actions pursuant to that clause have withstood constitutional challenge. The proposed legislative effort is to effectively reform health care in this country and provide coverage for all Americans. Congress' current efforts are a step in that direction.

    The direct challenges to our fundamental freedoms and to our constitutional protections that were contained in the Patriot Act seem to have been overlooked by many of the same people who are now complaining bitterly, and with much less if any cause, about the effort to extend health care coverage. This sudden concern reeks of hypocrisy.

  • How about the necessary and proper clause Article I section 8 clause 20. Congress can defend any bill passed as being necessary and proper. Who's to say what isn't?

    specially, the Democrats interior the homestead, the congress and the white homestead attempt to compel all individuals to purchase well being care less than the present commerce clause. there's no longer something interior the commerce clause that demonstrates the skill for politicians to compel voters to purchase something. I call that abuse of the structure. Others may call it distortion of the structure or over stepping the privileges of the workplace of the presidency. ** also, you may aspect out for your first poster that your question grow to be about the present administration. although, i can understand his confusion as his president looks unable to bypass on from the Bush administration. So unhappy.

    Congress was elected by the people to legislate on their behalf. The only thing unconstitutional is the filibuster option I would argue.

    My question to you is why were all Americans forced to pay for the Iraq war when half of them were against it? I don't want to pay for the private defense contractors like Hallibuton/KBR but I don't have a choice do I? Congress legislates on my behalf and if I disagree with each members decision, I will vote them out in the next election.

    It is the ELASTIC clause.

    If this healthcare bill passes you will see so many lawyers foaming at the mouth it will look like an outbreak of rabies. Most lawyers are probably holding their breath waiting for it to pass so they can rip it to shreds.

    convince Congress and stop it, take it to the supreme court and impeachment for bad president, witha a "God" complex past options that worked.
