Why is it that in islam, a woman will be stoned to death if she was raped?

Isn't that a little bit of unfair? i mean, how come that the man who raped the woman will live normal after raping a girl while the girl will be stoned to death. what kind of logic was that?

    who said that a woman who is raped will be stoned? thats not true. the man who raped her will be punished. who teach u ppl these lies?

    thats not in islam. islam is the perfect Religion, women are well treated, only those who do adultery will be stoned unless they repented.

    The punishment for rape in Islam is the same as the punishment for zina (adultery or fornication), which is stoning if the perpetrator is married, and one hundred lashes and banishment for one year if he is not married.

    Moreover, Ibn `Abdul-Barr (may Allah bless his soul) said

    The scholars are unanimously agreed that the rapist is to be subjected to the hadd punishment if there is clear evidence against him that he deserves the hadd punishment, or if he admits to that. Otherwise, he is to be punished (that is, if there is no proof that the hadd punishment for zina may be carried out against him because he does not confess and there are not four witnesses, then the judge may punish him and stipulate a punishment that will deter him and others like him). There is no punishment for the woman if it is true that he forced her and overpowered her. (Al-Istidhkaar, 7/146).

    In addition, the rapist is subject to the hadd punishment for zina, even if the rape was not carried out at knifepoint or gunpoint. If the use of a weapon was threatened, then he is a muharib, and is to be subjected to the hadd punishment described in the verse in which Allah says (The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter) (Al-Ma’idah 5:33).

    So the judge has the choice of the four punishments mentioned in this verse and may choose whichever he thinks is most suitable to attain the objective, which is to spread peace and security in society, and ward off evildoers and aggressors.

    This is untrue and unfortunate that it is being associated with Islam's name.

    How and why should an innocent and unfortunate victim of rape be stoned to death? If anyone deserves to punished, obviously it should be the rapist if the crime can be proved and if it can, they should be for it is one of the worst of crimes an individual can perpetrate on another human being.

    The punishment of stoning to death in Islam is a serious punishment applicable to aduletry. Even then for an Islamic state to carry it out, there is strict burden of proof required and several avenues for the accused to avoid it.     With all of that said, I cannot categorically deny that such unjust acts haven't been carried out by some in the name of Islam. Not only by muslims but even non-muslims in some parts of the world and this is indeed a disgrace.

    However, what I can tell you is that this has nothing to do with Islam and those who commit such acts are destined for a severe reckoning one day.

    I would also suggest that anyone making these claims cite their references.

    who told you that ? Islam does not say that , who ever told you that competely lies to you .

    You are absolutely right its unfair and un-Islamic , who ever told you this just want to turn you away from Islam but its good that you ask question here and hopefully your mis-conception was removed.

    this might be personal thinking of that man and compeltely against the teaching of Islam.

    In Islam the person who had raped the girl must be panished not the girl , the girl should be treated carefully and with love and treat him with good attitue to bring him to the normal life.

    Just a little request from you , if any body told you any thing just try to confirm him from the people who had knowlege so you wont get false knowlege.

    Thats not how it is in Islam, that is how it is in some so-called Sharia Law countries. They're laws are made and dictated by fanatics and extremists who are ignorant of the true teachings of Islam and would rather go about punishing people to instill fear and control than applying Islam and protecting the innocent.

    i don't understand why people go to websites rather than going to scriptures. in Islam there are two categories of sin. one is breaking only the law of Allah which state cannot punish him for for example not praying or breaking of fast. state cannot punish one but the moment any harm is done to any human the state is given the authority to punish that person.

    in you question you mixed up two things. one is adultery and other is rape. sex outside marriage is haram not only in Islam but in other major religions as well.but i will stick to Islam. if someone does adultery he/she has only crossed the limits of God so in this case 4 witnesses are required once it is proved 80 lashes for each culprit. but if someone lays an allegation on any woman and he fails to bring 4 witness that person gets 80 lashes.

    in rape only one evidence is enough. whether it is proved medically or by any other mean the rapist is put to death. no punishment for the lady. and i don't know of any punishment that says stone to death in Islam.

    Tom said in Pakistan 80% women in jail are because they were raped. i don't know where he gets this type of information from. i am from Pakistan and i know rape rate in my country. it's extremely low. and so far no court has put any victim of rape in jail. rapists have been put in jails not the women.

    there are few women in jails of Pakistan and they were involved in different criminal activities.

    She wont, where ever you heard that it's utter crap. Some scholars even apply this verse to people who commit rape with use of a threatening weapon..

    Meaning that a rapist could be punished by any of these ways. As for the woman, there is no sin on her and sometimes Muslim men are encouraged to marry women who were raped to protect them from stigma and exclusion and offer them some comfort.

    EDIT: Don't start about the four witnesses, DNA and CCTV evidence etc is perfectly valid proof in the Shariah courts.

    Don't. Leave her to Allah Let Allah judge her, not you. Stay patient and you could always advice her, remind her of Allah. I think it is best to help her, not hurt her! Allah knows best! These nonMuslims don't even know Islam, they have wrong information and think in Islam women are weaker than men which is false. its a bad idea about Islam made by those who hate Islam and some Muslims who had mixed their old bad cultures with Islam orders. Prophet Muhammad (peace be upon him) said: "Assuredly, women are the twin halves of men." in İslam which one is the closest to God ,is stronger, man or woman So in İslam everybody equal ... free your mind,Research İslam , read (Quran) and decide yourself :)

    Adultery punishment in the Bible's Old and New Testaments:

    The following Verses are from the NIV Bible:

    Exodus 20:14 "You shall not commit adultery."

    Deuteronomy 22:22 "If a man is found sleeping with another man's wife, both the man who slept with her and the woman must die."

    Leviticus 20:10 "If a man commits adultery with another man's wife--with the wife of his neighbor--both the adulterer and the adulteress must be put to death."

    Proverbs 6:32 "But a man who commits adultery lacks judgment; whoever does so destroys himself." He destroys himself by being put to death as shown above.

    Leviticus 21:9 "And the daughter of any priest, if she profane herself by playing the whore, she profaneth her father: she shall be burnt with fire." Why should only a daughter of a priest gets burnt to death if she profanes herself? Why can't this law apply to all daughters?

    Deuteronomy 25:11-12 "If two men are fighting and the wife of one of them comes to rescue her husband from his assailant, and she reaches out and seizes him by his private parts, you shall cut off her hand. Show her no pity." This doesn't make any sense what so ever! Why should the woman get her hands cut off for defending her husband? It's not like she was cheating on him or anything like that!

    We clearly see that adultery causes death from the Verses above. Let us see what Jesus peace be upon him said about adultery:

    The following Verses are from the NIV Bible:

    Matthew 19:9 "I tell you that anyone who divorces his wife, except for marital unfaithfulness, and marries another woman commits adultery." Wouldn't this cause the man to be put to death?

    Mark 10:11 "Anyone who divorces his wife and marries another woman commits adultery against her." Again, wouldn't he then be put to death since he would have committed adultery?

    Mark 10:12 "And if she divorces her husband and marries another man, she commits adultery." Same question I ask about the women who are considered have committed adultery. Wouldn't they be put to death also?

    Luke 16:18 "Anyone who divorces his wife and marries another woman commits adultery, and the man who marries a divorced woman commits adultery."

    My question here is: Would an adulterer in the New Testament be put to death?

    Keep in mind that when Jesus gave the above laws, he gave them during the time when he spoke highly of the Old Testament's Law:

    Jesus orders Christians to follow the Old Testament's laws: "Do not think that I [Jesus] have come to abolish the Law (the Old Testament) or the Prophets; I have not come to abolish them but to fulfill them. I tell you the truth, until heaven and earth disappear, not the smallest letter, not the least stroke or a pen, will by any means disappear from the Law (the Old Testament) until everything is accomplished. (Matthew 5:17-18)" It is quite clear from these verses from the New Testament that Jesus peace be upon him did honor the Old Testament and did say that every single "letter" of it has to be honored, followed and fulfilled.

    "Then Jesus said to the crowds and to his disciples: 'The teachers of the law and the Pharisees sit in Moses' seat. So you must obey them and do everything they tell you. But do not do what they do, for they do not practice what they preach.' (Matthew 23:1-3)" We clearly see in these verses that Jesus peace be upon him did not prohibit for the Old Testament to be followed, but only warned his followers to not follow it the way the current religious leaders of the Law (the Jewish Rabies) were following it.

    So according to Jesus peace be upon him, the adulterer in the New Testament must be put to death.

    so it is happening on pakistan cz people misunderstanding the law and making their own without having proper knowledge

    It doesn't happen in Islam. Tom Knight is enemy of Islam and Muslims. he is always doing false propaganda against Islam for last three years I have been seeing him doing it. He is crazy SOB.

    Secondly except in Saudi Arabia most of the law enforcers in other Muslim countries neither know application of Shariah Law nor have experience to enforce the law. They often make stupid decisions in judging the culprit. Such example are deliberately used by non_Muslims just to put down Islam and its Shariah Laws. Often they keep repeating same questions on one example they read in western press which may be a man-made fake story. In Shariah Laws if it is proved by four witnesses, the rapists gets death depanlty with out any exception if he is the son of the head of country.

    A married Saudi princes comitted adultry with a young man in Saudi Arabia. She left the palance with the young man and tried to flee from the country but both were caught on airport. A movie was make on that affair in late sixties and I saw it myself on American tv in 1972. The elder brother of the father of Saudi Princes ordered the death of princes and her lover both saying if we do not enforce law equally on all, then we will be unjust and very bad rulers. I saw in movie princes and her lover both were shot in head in a public square.

    Adultry is worst social crime and Islam is not lenient on such behaviour. In west there is no law against the adulterers of they both do sex with their consent. Such laws encourage divorces and

    breakage of families and worsening the lives of children. Westerners are extremely selfish and never think about devastating the lives of their children for their personal pleasure and have no shame in telling about their affairs. But they love to criticize Islam calling it Shariah Laws too hard, barbaric religion etc. etc. and call themselves civilized people though when they have urge for sex, they sleep with any one they can find. That's one of the reasons that they have 55% divorces within five years after marriage. Majority of them have sex for years before marriage. That makes them habitual of changing sex partner and they can't live with one wife only. Virgins girls before marriage are rare speci in western civilization these days.

    I don't mean to put down all westerners. Lots of westerners are good people also. But lots of them young men and women feels freedom to have sex when ever and with whom they want. They are also having very high number of abortions (baby killing) and adaptions of babies with strangers concealing identity of parents of children. When they grow up and find that whom they thought their parents are not real parents, it is devastating for them and they start looking for real parents. But no one tells them where the real parents because by law information is conceal with biological children. In Islam it is considered a great injustice for children.
