Why wasn't Aaron Burr tried and convicted of murder?

He killed Alexander Hamilton ins a duel.

according to wikipedia,

"Burr was later charged with multiple crimes, including murder, in New York and New Jersey, but was never tried in either jurisdiction. He fled to South Carolina, where his daughter lived with her family, but soon returned to Philadelphia and then on to Washington to complete his term as Vice President."

Ok.............so law enforcement was like, "oh nevermind, even though you're being charged with murder, we'll let you continue serving as vice president."

Can you imagine that happening today?

Imagine if Dick Cheney took Colin Powell hunting, and he shot and killed him.........

and then returned to Washington D.C.. to continue serving as vice president..

Police would have been on his a** before that could ever happen.

This is a prime example of how things were then and are now. A duel is how two men decided to answer a disagreement, if it got to that point. This is actually very important in politics though, again it just shows how times, people and policies should all change in proportion.

Because he killed him in a duel. The thinking back then was that dueling was not murder. Both parties faced each other under equal terms. Granted, Hamilton reportedly missed Burr on purpose (one must remember that Hamilton saw a lot of action in the Revolutionary War and was in more than 1 battle.) but Burr shot Hamilton anyway. It was a different time and people thought differently about things back then.

You can not look at history through the lens of today. You have to take into account how people thought in those times and how they lived day to day.

Dueling was illegal in New York, with the penalty being the death penalty. That is why they took it to New Jersey. It was also illegal in New Jersey at the time, but with a much lesser penalty. New Jersey did not prosecute Burr because, although the duel occurred in New Jersey, Hamilton died in New York. Presumably they could have tried him for dueling, but not for murder. He avoided going to New York for almost ten years. Although, there is no statute of limitations now on murder, and probably was not then, Burr was broke, totally discredited, and there seemed not to be any public pressure to try him.

yes he did, however in that time period DUALS were a part of life, much like murders are today the only difference is at that time both men would agree to a DUAL knowing full well the consequences, unlike today when you have punks, thugs, gang-banger, and want-to-be gangsters who kill people because they are uneducated, moronic, stupid, in-breed hillbillies. In my opinion take all Violent Criminals who Murder, Maim and rape, put them in a room full of Guns and let the Animals take out the Animals, and i do not care if you are black, white or hispanic if you terrorize our communities you yourself do not deserve to live, so i very much admire the time of Aaron Burr, because the law did not stand in the way of true justice.

It was a duel. During that time period dueling was legal. Do not judge events then by the standards of today. If you are going to do that, how come Tom Jefferson was not tried for the rape of Sally Hemmings? How come Washington was not tried for owning slaves?

Far as I have been able to determine, the duel took place in New Jersey, which had yet to outlaw dueling.

Dueling was an honorable event at that time. It was not outlawed till later.

Charges were never followed up in most dueling cases.

Not sure "what" murders he committed, but you have to remember that "dueling" with pistols was "frowned" on but NOT illegal. If all his "murders" were by duel, it would have been a difficult proposition to prosecute.
