human resources wants to send me back to mexico because i got injured at work is that legal?
work in canada with a work visa.i am a waitress. 2 months ago i injured my shoulder and neck and i haven´t been working in the last month. workers compensation is paying for my physiotherapy and the doctor don´t know when i am coming back to work. human resources is waiting for the results of a cat scan but they tell me that if i don´t recover as a server they probably are sending me back to mexico. i asked to be transfer to front desk because i cannot lift anything but they would have to change all my papers. so is it legal that the only option they are giving me is go back to mexico??? help!!

Your employer is not obligated to give you another job. They hired you to be a server. If you arrived in Canada because this employer secured you a visa to be a server in their establishment, and you can no longer perform the job, your visa will no longer be valid. WCB will still cover the cost of your physio.

Your best bet would be to speak with the immigration officer handling your case.
