Child Care Taxes problem...Help!?
I have been babysitting a little girl in my home for 1.5 years now and when her parents and I agreed on what I would charge etc. we also agreed to "pay under the table" and leave taxes out of it since it would be cheaper for both and only a few hours a week. Well now on tax day, today, she send me an email that says she needs all my info for her taxes? What do I do? She has not been paying me taxes, and or paying me more to cover taxes. She only pays $5/hour so if she wants me to be taxed on $5, she's nuts! She knows I am not a licensed daycare provider so I am just a bit confused on what the heck is going to happen now.
I have already filed my taxes, so what do I do now if I want to make it legit? I am fine with being legal, its just that we agreed we were doing "under the table" and now today on the 16th she asks for my info? It's just crap! And to those of you who want to chastise me for being illegal, I get it, I will never do this again, I was clueless as to what it entailed, I have learned my lesson.

An agreement to do something illegal can't be enforced, so you're out of luck there. When you didn't include the income on your return, you illegally evaded taxes - the only way to fix that is to file an amendment claiming the amount and pay what you owe. That's true whether she claims it or not.
If you refuse to give her your info, she can still claim it on her return by giving your name and address ane noting that she asked for your other info, but you refused even though you're legally required to give it to her.
Talk to her and let her know the rate is going up.

If you have been paid in cash every time then they have no proof they have paid you anything and can not claim the expense on their taxes if you don't give your personal info to them. If they have been paying by check then it isn't under the table and there is a paper trail of which they can prove and in that case you have a problem and need to claim the income.

DON'T GIVE HER THE INFO AND TELL HER IF SHE WANTS TO CLAIM YOUR FEES IN THE FUTURE, YOU WILL HAVE TO INCREASE YOUR RATE to $8/hr TO COVER YOUR TAXES - and you will give her your tax info at the end of 2010 - BUT, then she might file an amended return for 2009 and screw you that way, so I would just say it's $5/hr - no taxes and no tax information
