Should breeders be charged with fraud?
A friend of a friend of mine was tricked into buying a five month old dog de bordeaux with severe hip displaysia for £800! The breeder told her the reason the pup keep falling over was because she was so heavy boned and this was completely normal!!! The poor pup had to be put to sleep because the displaysia was so bad! My friend told me her friend said the mum and dad were both KC registered and so wer the pups, she told me she got the papers with the pup? So should the breeder be charged with fraud as they MUST have know this pup was not right, yet they still went ahead and sold the poor we thing under fales pretenses, and can the breeder be repored to the kennel club so any future pups from the breeding pair can't be registered?
Yes she was very stupid for buying this pup, but she was a first time dog owner and was taking in with the breeders charm and b*******t. I am not sure if she got any contract health or otherwise. It just makes me mad people can treat animals like this for a quick buck. I have two ped dogs and the breeders wer great but people like that just give good dog breeders a bad name. p.s. the breeder is from Scotland not England
Chez if you could read properly you would see I said I own two ped dogs a rottie and a staffy and i've always owned dogs from childhood so wouldn't be so gullable as to buy a defromed dog!

The best thing your freind do is first contact the kennel club and ask if she can report this breeder to them. And then she can take the breeders to small claims court and try and get her money back and any bet bills. She will need proof from the vet that the puppy had to be put to sleep because of the hip problem and also letters from reputable breeders of the breed who can prove what the breed told them about them falling over was something to do with her being bid boned was rubbish which it is this will help prove the breeder knew the puppy had problems and sold them a badly breed puppy with problems..

What kind of health guarantee was in the contract they signed with the breeder? Most reputable breeders will show proof of HD testing on the breeding dogs and have a health guarantee for 2-3 yrs against HD (can't test for HD till 2 yrs old).
If there was no contract, your friends really don't have much recourse. I'd consult a lawyer and see what, if anything, can be done against the breeder.

Not all breeders are like that. You friend had the choice to sue the breeder for selling her a deformed dog. And if the dog was falling over at time of purchase then why did they buy it, a puppy falling over would be a true sign to me to stay away from that dog.
And just because one pup has a deformity does not mean all pups from the litter or future litters are going to have same deformity.
I blame the buyer to for not seeing this at time of picking the puppy.

Your FRIEND is a moron. Any normal person would have their pup examined by a vet within 48 hours, as required in the breeder's contract. Why are you so concerned about a friend of a friend's dog? KC papers mean absolutely nothing, they don't guarantee health and hips. TRICKED into buying?

Your friend should have gotten a health contract. No one tricked your friend into buying the dog- she did that on her own and who would really buy a dog that is falling down? That's just stupidity. KC registration is not a guarantee of quality. Your friend can try to sue, but in the end, if she didn't have a health guarantee she is out of luck. There are plenty of reputable bordeaux breeders in England. She should have gone to one of them.

Any true breeder should see the signs of hip displaysia the heavy boned story was rubbish. So yes take them to court and go for animal cruelty as well.

The regulation is diverse in each state and usa. In my state, fraud calls for an affirmative misrepresentation, going previous mere puffery, that's relied upon with the help of the customer. The regulations imposes few responsibilities to exhibit. in addition to, except you have been a sufferer of the fraud, you have not any declare. As to criminal fraud, there is not any inner maximum criminal prosecution interior the u.s. in case you think of you already know of a criminal offense, notify police. they could check out and then the DA comes to a decision no count if to apply taxpayer money to seek for a criminal conviction.

Why have I got this strange feeling that this ain't a story from a friend of a friend and it is indeed you!
If this is the case I would contact your kennel club and mention all this to them and see what they advice you.
