Is it legal to capture firearms from enemies when you are in the military?

I'm not actually in the military, I'm just wondering.

You cannot take trophies, I.E. taking the weapon and adding it to your personal collection. However as far as confiscating them and turning them over to our military, yes that is the protocol. At least until our Commander In Chief changes it and makes it illegal for us to take the enemies weapons away because that would be unfair, and they wouldn't have anyway to defend themselves. (God help us, we still got 2 more years)

If you have caught the guy, then of course you steal their firearms.

Only if you're using the "Scavenger Pro" perk otherwise no...well on second thought I guess you could just fast swap a weapon by pressing and holding "X"

Why would you bother? Anything they use can be purchased at most U.S. department stores, if not vending machines.
