Private Party Gun Sales?
Are private party gun sales legal in New York without performing a background check?

My usual go-to place for questions like this is the state Attorney General web site. In New York's case, this is unhelpful. My next choice is the NRA website. See the source section for a synopsis of state laws on purchase, possession and carrying of firearms.
Private party sales are not addressed explicitly, however there are rules of ownership with implication about background check. These two sentences from the report should inform the remainder of your inquiry.
"No permit is required for the purchase of a rifle or shotgun (except in New York City).
A license to carry or posses a pistol or revolver is required to purchase a handgun."

You can sell your gun, in state, to whoever you want. Guns aren't "registered" to anyone, unless they are fully automatic or short barreled weapons, destructive devices, etc. An E trace could be done by serial number if the gun ever were used in a crime. If you bought the gun at a dealer and filled out that yellow ATF form where you inital that you aren't a convicted felon and all that then it MAY show that it was sold to you (assuming nobody somewhere along the way lost the paperwork). But all you would have to do is say that you sold it. No further action would be required by you. If you want to be thorough you could always fill out a bill of sale with the serial number on there and have the guy sign it. Then keep a copy for your records just in case. There is no other way for you to record the sale unless you can convince a dealer to handle the transfer for you. Most will not do that though unless the gun is being shipped to them, then they would charge a fee for handling the paperwork.
