Who's responsible for rental car insurance after an accident?

Last month my car was run into in a parking lot while I was shopping. No question who was at fault. We exchanged information and I contacted their insurance company. Their insurance agreed to pay for all repairs and the rental. However, they did wouldn't pay for the insurance on the rental, claiming it is my responsibility. I only have liability, so the additional insurance cost $8.99 per day, in the end I had to pay $360.

I'm wondering if now I can take this to the people who hit me, since if they had not hit me, I wouldn't be out $360. Could I demand them to pay it, maybe even take it to small claims?

This is in California.

Update 2:

Looking over my receipt it does state twice that the insurance I paid for is optional. However, the agent made it seem as if I could not rent a car without it (possibly because I am under 25).

    The renter.

    The insurance company only owes you reasonable reimbursement for your loss of use. If you choose not to purchase collision/comprehensive coverage on your vehicle -then the at fault drivers insurance company does not owe you insurance. By paying the daily rate and tax, they have met their legal obligation to you.

    You are out the $360 per day because you decided not to purchase physical damage coverage on your vehicle.

    You can demand all you want to - they still won't pay it.

    You can go to small claims and will probably lose.

    This is pretty standard stuff.

    You may want to see about getting a rental car from Hertz. In my area, they will let you be personally responsible for any damage you cause to the rental car.

    It was your choice to get the rental insurance, and your responsibility to pay for it.
