The Constitution allows Congress to raise and collect taxes. They could literally tax the air you breathe if they wanted to. The 16th Amendment to the Constitution removed the apportionment clause from the Constitution allowing for the unapportioned income tax that we now have today.

The income tax is perfectly constitutional.

The people that say that it isn't are called "tax protesters" and they have various theories. While their theories vary, they all have one thing in common. Since 1913, not one of them has been victorious in a court of law and gotten out of paying their taxes.

Tax protesters like to put various conspiracy theories together. They claim that the income tax only goes to the Federal Reserve which is a private bank to pay interest on the debt. This is wrong on multiple levels. The government collects about $1.1 Trillion in personal income taxes and pays about $250 Billion in interest. That interest is paid to whomever owns the treasury securities. Personally, I own some in a mutual fund so I get some of the money (very little however).

File your returns and pay your taxes. You will be much happier in the long run. Tax protesters tend to end up broke and alone. Sometimes, they end up in prison.

...and stop taking financial advice from this friend. If he believes these theories, he may be on his way to financial ruin.

  • Read Article 1, Section 8 of The Constitution. It states, in part: "The Congress shall have Power To lay and collect Taxes, ..."

That's ALL the authorization that Congress needs to enact ANY tax. They could legally tax the size of your wiener if they wanted to and it would be absolutely Constitutional.

There's no ban on committing murder in The Constitution; good luck using that argument in your defense if you are charged with murder. There are no speed limits in The Constitution either but that won't stop you from being cited for speeding in a national park or get you off the hook for doing so.

Your question is purely too long. in spite of the shown fact that, i'm going to upload my own little bit of confusion. i think this is illegitimate to tax the Social protection earnings of retired human beings. The contributions that workers make to the Social protection administration are made with after-tax money. hence they have been taxed already. once you get carry of the money lower back this is taxed lower back. Double taxation is unconstitutional.
