Which Amendments or Clauses of the Constitution has Obama violated??Explain..?
And please.. Don't say Presidents can't do something because it is not in there. That's a fallacy.
Park Park..
When did he violate it??
By the way, while I admit some powers aren't specifically granted by the Constitution, that is why the 10th amendment was modified from the original language.
"The powers not (explicitly) delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
That was a historical moment when the forefathers told park park to shut the hell up over 200 years before he opened his mouth.

"To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes"

What are the boundaries regarding the Commerce Clause??

None. I don't think he'd be likely to make mistakes in that regard. He graduated top of his class at Harvard Law and taught Constitutional Law at the University of Chicago. Don't believe some entertainers who are high school dropouts and know a few quotations so they can pose as experts on talk radio. Obama is a bona fide expert on the Constitution.

No, you're wrong about what you're saying is a fallacy. If the Constitution doesn't expressly articulate a power as belonging to the president, he is usurping some other power. Either the legislative, the judiciary or the people of the several states. I think Obama has violated the Separation of Powers doctrine several times. I think he needs a civics refresher course.
Source(s): brucec83, you're right about his credentials which is just really scary when you think about the lawyers out there who were taught con law by him. They are probably committing malpractice daily. Yes you can violate the separation of powers. It is a built-in check and balance on our government. Don't call me an idiot, prove me wrong. Right, you can't, which is why you name-call. http://www.sodahead.com/united-states/how-many-cha... - Anonymous1 decade ago
Here is a start:
Certainly he has overreached on Article 1, Section 8, clause 3 (Commerce clause) when he signed an unconstitutional bill that mandated all citizens to purchase health care.
Clearly, on several occasions, he has stepped on Amendments 9 and 10 on numerous occasions, for example, suing Arizona (while ignoring San Fran, etc) or imposing agenda-driven drilling moratoriums.
And please.. Think about these examples! There are a lot more but this is a great start

Article 2: section 4
The president, vice president, and all civil officers of the United States shall be removed from office on impeachment for and conviction of, treason, bribery, or other high crimes and misdemeanors.
The attempted bribery of Romanof and Sestak are impeachable offenses. Congress is bound by their oath to impeach him and remove him from office.
Amendment 4
No person shall be... deprived of life liberty or property without due process of law...
The new financial bill gives the president and treasury secretary power to seize and break up any company they feel poses a threat to the economy with no legal recourse or due process available to the company so affected.
Extorting money from BP instead of taking them to court violated their right to due process.
Article 1: section 9
4. No capitation or other direct tax shall be laid unless in proportion to the census enumeration herein-before directed to be taken.
Laying a 90% tax on bonuses paid to AIG executives is a direct tax.
Article1: Section 9
3. No bill of attainder or ex post facto law shall be passed.
Standing law said that oil companies shall not be responsible for more than $75,000,000 in liability for accidents or oil spills. Trying to hold them liable for full damages after the spill happened is an ex post facto law.

The mandatory purchase of health insurance will have its day in court to determine its constitutionality. Its not so much that he violates it. He just bypasses it. If you are young, you will notice that in your lifetime. What Obama has done will have a profound effect on your income and your quality of life.

Presidents can't do something if it is not in there-that is the Tenth Amendment. Try reading it some time.
Source(s): Since Liberals like you treat the Bill of Rights like Dracula treats a cross, I'll force you to read it: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
