i need help with someone who abused me on Ebay?

I sold an item on Ebay only a few weeks ago, and it specifically stated on the auction that handling times would up from 6 - 11 days. On the 4th day of the item being sold, i jumped on to write down the address as i was going to the post office when i noticed i had negative feedback. It was from this person who won my phone. The feedback said "He is scammer DONT buy anything off him. took me for $265.00 a kid how weak!!!"

So, i didn't send the item, instead i contacted Ebay and told them everything!! I would think that because i stated the 6 - 11 days handling times that i would have at least half a leg to stand on - obviously not!!

I didn't hear anything back from Ebay until i received a Buyer Dispute. I was Furious. Meanwhile this person and her son have added myself, partner and all family and friends on Facebook and have been bullying us for quiet sometime. Saying they are going to come find us, bash us & that there husband/faher is a federal agent who is going to come get the item.. etc.. We blocked and deleted both people. The next day my partner went to work and got the SACK! turns out his reason for sacking was what these people had told him. The added my partners boss (friend of the family) and all his work mates and fed them absolute bullsh*t!!!

Anyway, i am SO FURIOUS!!! No one trusts us anymore yet we have done nothing wrong. I offered to give a refund (of course) as long as they apologise to myself, partner, friend & family and also remove the disgusting feedback left on my page. Is that a fair thing to ask? Because they dont seem to think so. I know that if i refund there money i will never hear from them again and that will be it. they will get away with ruining our lives.

If i took this matter further, would i have a case? And who would i go to? (lawyer? police?)

Ive tried PayPal & Ebay resolution centres. They have done nothing!!

No smart **** answers please, i just want your opinion or knowledge. What would you do?

You could ask a lawyer for advice, but the only thing the police might perhaps be interested in is the threats of physical assault - you could apply for a restraining order against these people.

Because E-bay is a private buying/selling site, you enter a contract of sale when an item is purchased and this makes it a "civil matter" that the police wouldn't be interested in. It may cost you money in legal fees, but it might be worth it to get the E-bay resolution centre listening to your concerns. If they wont respond to you, I'm sure they will respond to a letter from your lawyer.

I try to avoid all online auctions myself for reasons just like this. I believe that a person should be only allowed to leave feedback at least 10 days after the conclusion of the auction to avoid these things happening. Some people obviously can't be trusted to do that right thing obviously.

Well a lawyer might consult you on how to go about this situtation, but i think you have to pay to ask anything to a lawyer im not sure you can try, or try going to the police first i guess and if they don't seem to answer your question then go to a lawyer. You've sended emails and called ebay right?
