not getting paid, am I being unreasonable?

I guess you would call me an independent sub contractor...I work for a contractor but am not officially an employee. I work for them regularly and depending on the job usually get paid every two weeks sometimes more often if smaller jobs. recently we have done two jobs that the contractor didn't get paid for. It's now been over a month for one and two months for the other and I still haven't been paid for them. Contractor claims they will pay me when the homeowner pays them. I feel this isn't fair to me. I don't really work for the homeowner (or I would have got more money upfront to cover my employees) I also don't have stocks in this company, is it my problem they didn't get paid? I have no contact with homeowner I can't ask for money from them or get reason why not.

Am I being unreasonable? Is this common practice?

one job was complete the other was not completed and won't be by us but again is that my problem the contractor is having issues with the homeowner?

Update:

nothing written and I am currently being asked to start another job tomorrow, and I am not really willing to until some money is paid but messing myself without working

What does your contract say? You should have a written agreement with the general contractor. No agreement, you've got a problem. Yes, you should get paid for the work you did for GC. Chances are GC hasn't got a pot to **** in or window to throw it out of until the homeowner pays him. You may well be sunk unless you have a written agreement/contract. So what do you have in writing?

Yes you are owed, but my guess is that your boss does not have the money to pay you till he gets it from the 2 jobs you are owed. He most likely had to pay for materials to do the jobs and now is out of pocket for that plus owing you.

Many contractors live from job to job to survive and you are in the middle of this mess. Until he works out the problems with the homeowner, you will have to wait. You could sue him in small claims court, but may find yourself w/out a job period.

    good luck
