Car stolen and now there is some damage, who pays for this?

I had a car stolen and the thief decided to pull the ignition all apart, he also put a dent on the front fender. The car thief was arrested but now I need to pay the bills. Is the only way to get money from him to sue him, or is there another legal way to get money out of this guy?

Update:

Insurance is only liability, so it doesn't cover.

Assuming you have auto insurance, your insurance company should cover the repairs including no deductible for you since it was theft. So contact your insurance company and go from there.

If for some reason, your insurance doesn't cover the expense, then civil court or small claims (depending upon value) is your only way to recover from the thief.

If you have insurance and the damage is more than the deductible they will take care of it. Taking the guy to court will likely have no dividend. Take it up with the insurance company or just pay for the repairs yourself. Thats life.

Your insurance pays for the damage. There is no use suing someone who has no assets. You would spend thousands for an attorney and get nothing in return.
