If this just happened, you can file for custody in your current state, as they still have jurisdiction over the custody of the child. The state will find her and serve her with the summons. You can include in the case a request that she return the child to the state. If you were abusive to her, though, be prepared to lose your case.

If the husband has full custody, the mother CANNOT take the child anywhere out of the state or country without his permission and he can press kidnapping charges against her. It should also be noted to the courts that the mother is with a man who has warrants, is abusive, a drug user and she is behind in her child support payments. This woman should not be around her son at all and the courts should know about it.

You can seek an attorney for the state involved as statutes vary from state to state.
