Reporting sexual discrimination in hiring question?

If you saw an ad looking for female bartenders, specifically female, who in your state or federal would be the best to report that to?

    Well first you have to determine if the establishment employs enough people to be subject to the discrimination laws. If the bar is small enough with < 15 employees, they can hire whomever they like as they are not subject to the Civil Rights Act. Second, the bar may qualify hiring female bartenders as a "bona fide occupational qualification" depending on the nature of the atmosphere of the bar. This is how asian restaurants can hire only asian servers, for example. They can show that it contributes to the overall ambiance and atmosphere of the establishment.

    Absent a legal reason for the advertisement, you can contact your state's Human Relation's Commission or the federal EEOC. BUT first, you must have been discriminated against (i.e, you must apply and be turned down because you are male). It is NOT against the law simply to advertise for a female.

  • That is not a sexual discrimination, if a company perfer a female bartender he can do so, just like if they perfer a male bartender, could be the owner wants tp even things out (a male and a female bartender).

    This has nothing to do with sex. Sexual discrimination is someone who made a sexual act by verbal or touching by either gender.
