Whether or not the child will be eligible to receive a British passport will depend on the date of birth of the child.

If the child was born before 30 June 2006, the child cannot be a British citizen unless her parents were married at the time of her birth as until that date, fathers could only pass on citizenship if they were married to the child's mother.

If the child was born after 1 July 2007, the child may be eligible for a British passport, however because the father was not named on the birth certificate, the parents must provide a paternity certificate obtained from the local registry office. The father can swear the declaration of paternity in front of a consular officer from the British Embassy in Moscow by making an appointment. Alternatively, a DNA test can be carried out to establish paternity. Payment of maintenance is not sufficient proof of paternity alone.

The mother will need the following documents to obtain a passport for the child:

    - Full birth certificate.

    - Paternity certificate from the local registry office.

    - Original postnatal record from the maternity hospital

    - Mother's Russian internal passport

    - Father's original British passport

    - Registration/naturalisation documents from the Home Office if the father is a naturalised or registered British ciitzen

The mother can apply at the British Embassy in Moscow or St Petersburg.

EDIT Oops! I meant If the child was born after 1 July 2006, not 2007.

You can file for Consular Report of Birth Abroad. They'll most likely request DNA test.

    Contact the UK embassy.

They should insist on a DNA test to prove his paternity. I don't know how easy that is in Russia though but I'm sure the evidence of maintenance payments would be helpful in any court case. Good luck xx
