Can a website use an unregistered/untrademarked logo without permission?

A non-profit organization for which I am president commissioned a graphic artist to create artwork to form a logo for the group. Does the artist retain copyrights, or does the organization hold copyrights if exclusive rights have been granted to us? If a website published this logo without our permission, are they in violation of copyright law and do we have the right to demand that it be removed? Does it matter if the group has not trademarked the logo?

The person or group who purchased the work would normally purchase all rights to that work. In other words they would own the copyright. But it\s all dependent on the contract.

If another person or group uses the logo without permission, they are in violation of the copyright of whoever owns the logo.
