is it a legal requirement that both biological parents have to give permission for?

I may be wrong but alarm bell's are ringing , my former partner whom believes she is above the law and can do just as she wants as regards my daughter , we went through the mine field of the family law courts , for two years !! where she was refusing contact , just as the judges concluded / permitted contact , she became very amicable and allowed contact on her terms ( for her own reasons ? ) however , the games continue , I noticed on my daughters school book , that her surname was different ? now without sleigh-ting the mother which I avoid at all cost's , she has proven to me , my daughter , my family her own included and the courts , police that she does lie ,

and will commit fraud in order to get what she wants and only to hurt myself . could she and her partner apply to adopt without my consent ? how would I know ? whom do I speak to , how would I find out if this has been done ? as a choice of preference avoiding the courts ! any help / advice would be appreciated

Update:

she refuses to accept maitainence informing the CSA as such and I have a confirmation letter of the fact

    she cant apply for adoption without your consnet to it

    if she outs in application then the adoptioon services would by law have to contact you on this

    I don't know what state you are in but in New York both parents are required by law to approve the adoption of a child to the step-parent. I adopted my step-son with his biological father's consent and once the process was done and approved by the courts we got a new birth certificate with the removal of his biological father's name.

    If you want to know if your daughter has been illegally adopted by someone else you could request a copy of the birth certificate which legal parents are allowed to obtain (in NY one parent can obtain a copy without the knowledge of the other). If your name is NOT on the birth certificate anymore your request will be denied because to the local health department you are not the legal father (which in your case would have been done without your consent). Again, I only know how NY works and a birth certificate request in NY is approved for parents who's names are on the actual birth certificate so again if your name is not on it then in NY they would deny you a copy and that's how you would know you are no longer on the birth certificate.

    This is the simplest least expensive why I can think of without having to phone a court or getting a court involved. If your name was never on the birth cert then this option probably wont work for you.

    Are you paying child support? If you are contact the attorney general's office you have the right as a non-custodial parent. If you are not paying support you will need to get a lawyer, after a certain amount of time if you are not active in the child's life the mom might claim abandonment.

    Well thats life I'm afraid. Everything is on their side due to liberals like courts, law, government.
