my big dog bit her little dog?

If you don't know the legal issues about this please don't guess.

My 17 year old son was walking our dog on a standard leash. A person on the same side had a small dog on a retractable leash. My son pulled the dog in close to his side and the small dog ran up to mine, with the retractable leash running out, and got bit.

Is my son (or me) at fault in any way? Am I responsible for the other person's vet bills?

I feel that I am not because my dog was under control, hers was running out away from her on the retractable leash and she didn't retract it.

Thanks for any guidance while I wait for the phone to ring.

Update:

thanks everyone. I just talked to the owner. she is not taking her dog to the vet. she said there are abrasions, but nothing dramatic. I told her if there are costs I will split the bill 50/50.

    The legal issue is YOU are 100% liable for EVERYTHING your dog does. The ONLY possible exception is if the other party illegally enters a location your dog can't get out of.

    If your dog bit the other dog without being ordered to do so, it was NOT under control in the eyes of the law.

    YOU ARE NOT AT FAULT if you had the dog under control. I have had the same problem and you are not responsible for the bill and this is why . If your dog is chained up in your yard and a small dog wanders in and gets attacked is it your fault ...no she needs to train her dog or get a shorter lesh

    Your dog did the biting, so yes you are liable for this.

    The law addresses viscous dogs, not who had the longer leash. Your dog attacked the other, You are liable. In some places they could demand your dog be put down for this.

    Your control of your dog means that you can not be charged with a criminal charge, but it does not change the actions of your dog.

    As a owner of a small dog who just got badly injured by a big dog I would say it was her fault just as I say it was my fault my dog got hurt in a situation just like yours.

    Noccie, I think her dog was clearly at fault, hence her decision not to take action. Your offer of 50/50 is very generous

    it is not your fault because it was the other persons dog that went to you so you did nothing to provoke this from happening.

    im guessing that its their fault, but you should contact the owner of the other dog and sort it out

    well the other person was stupid and didn't keep her dog under control, but you may need proof idk.
