Vis a vis Omar Khadr...?

Can someone please explain something? Omar Khadr was prosecuted by the USA government

for murder. But he was fighting in a military battle. I understand how he could be taken as a soldier of war and imprisoned as such but how could he be subject to criminal prosecution?

    Omar Khadr was prosecuted by a military tribunal as an enemy combatant. He threw the deadly grenade after the fight ended, after the other surviving insurgents had fled or surrendered, while wounded and pretending to be dead. The laws of war apply to militaries that comply with the laws of war. They don't apply to civilians killing anybody. As a canadian citizen who killed a citizen from a friendly country, he earned the right to be called a murderer. Canada and the USA are not at war.

    Because in a war it seems that americans are allowed to kill anyone (even civilians) without fear or being charged of anything but if one dares to fight back they will get charged of murder. Omar Khadr was accused of killing an american soldier with a grenade. That grenade was american by the way. Was thrown by american soldiers first and was thrown back to americans when it exploded and killed an american soldier. Then the soldiers killed everybody where the grenade came from. Omar Khadr was the only one who survived and was then arrested and transferred to Guantanamo.

    The worst thing is that he was 15 at the time. Under international laws, child soldiers cannot be accused of any crimes as they cannot be hold responsible for their actions. But the american military doesn't seem to care.

    He shouldnt be and this entire case it a complete farce. The initial battle report states that the combatant who threw the grenade that mortally wounded Speer had been killed. The report was later changed. Khadr was also 15 at the time of the battle and International law clearly states that a child soldier is to be giving rehabilitation rather than punishment for their actions. But none of it really matters because the Guantanamo trials are meant to put a face to terrorists, punish them, and give the general public the sense that their government is doing some good. Whether they are guilty or not seems to be of little importance
