How do I get my possessions back from an ex's house (i lived there 6 months ago) without breaking the law?

I paid cash for most of the stuff and unfortunately didn't save receipts, and a lot of the stuff was gifted to me by my family. I left it at first because I didn't want to completely take everything out of his house (The only things he bought were big pieces of furniture) and I felt bad. He said at first that he'd pay me for the stuff and then later decided he was gonna keep it. He says he gets to keep it because I didn't pay rent- but there was no agreement to pay rent he never once asked me to. He bought the house and I lived there with him for the first six months that he owned it. Anyway I'm moving out now and want my stuff back and can't afford to re-buy most of it and the gifts aren't going to be gifted again. Any advice?

    Hi, You can go to the police department and talk to them about this situation. You may be able to get them to accompany you to get your belongings. Local police should be happy to standby to prevent a confrontation and ensure your safety while you gather your stuff - IF he lets you in. However, police cannot and will not force him to allow you into the residence, or to have access to get the stuff. If he says "buzz off", then that's what you'll have to do. Police can drive up and sit for a few minutes, and that's the limit of their involvement. A deputy sheriff (who is, by definition, an officer of the court) can help you accomplish the return of your items, but only when you have an order from a court, which you get by suing. You can do this through small claims court. Theft charges may be able to be brought but, that would be up to the police. They may talk to him for you. That's where I would start. I would also let him know that I am going to the police and intend to do whatever it takes to obtain the return of my property. You'll need any and all proof you can get from friends, receipts etc. It's not necessary but, will help. JOSA

    Did you pay for the things with a check or debit or credit card? Those can be used as evidence that you purchased the items. Just find your old statements for anything you can to prove it's yours.

    You've got a couple of options you could sue him in small claims for the dollar amount so long as it's not above $7500 (I believe that's the limit for small claims not 100% sure).

    You could also go to the police department and file a theft report of some kind. I would do that before you try to sue him for the items.

    If you have to take him to small claims get statements from family members that they were gifts. You might also see if they can come up with a paper trail of any kind for the purchase of the items (bank statements).

    The more evidence you have to prove that they are YOUR items the more likely you are to win. You can never have enough evidence to support your claim.

    That's where I would start if I was in your shoes.

    sue him. March him in to a series of small claims court actions, especially with the people / witnesses who gifted or gave you property. Dig up receipts or warranties to help with the cash stuff, Or take the guy to superior court... together with all the witnesses you may get a kindly verdict that opposes your ex beau's blatant self dealing.

    what about his rights. By your own admission he was found not guilty so stop playing silly games and give him his things. I suspect the only reason you are planning to be away is to be difficult. The only way to be done with this situation is make a clean break, so give him his stuff before he takes out court orders against you. Who knows, you might come off worst if the court finds you are being obstructive.

    The point is this: it is NOT his stuff unless you gifted it to HIM or he has proof that you intended to abandon it or he has a court order that gives him the right to satisfy your "unpaid obligations" by hocking your stuff. His POSSESSION of your stuff is not TITLE to your stuff. Obviously anything that was his is still his (he purchased it, received it as a gift, etc), and you have no claim to any of that, nor anything that he may have borrowed from a third party (e.g., that blender belongs to his mom).

    Notify him immediately, certified mail, return receipt requested (notary doesn't matter), that you continue to claim ownership of the enclosed list of items that belong to you, never belonged to him, that they were temporarily left in his care, and that you want them protected from damage or theft until he can return them to you. Enclose as detailed a list as you can think of. Request a quick meeting at which you can discuss a simple and quick resolution, preferably at his house. This may incidentally allow you to identify additional things that you see there and had forgotten you'd left. In the letter, set a date by which you want a response, "after which we may have to get the lawyers involved". That may be enough to swing him to the proper thinking: return this stuff to you or suffer the consequences.

    Yes, you have the burden of proof if you try to sue someone. You allege ownership (with affidavits from witnesses and anything else to support your claims) and that he's in possession, he tries to counter with proof that it was gifted by you (show me the birthday fotos, dude), you counter his counter with a copy of the certified letter (claiming ownership) and an affidavit of denial of any intent to gift or abandon those specific objects.

    However, you can sometimes use the leverage of a criminal complaint (embezzlement of one or more things of value) to spring loose the return of any number of other things that he knows are not his. "Doood won't give back my guitar, and a lot of other stuff, so if I charge him with stealing it, maybe he'll give back all the other stuff too, rather than have a long record of theft for every single thing I want to charge him with in the future..."
