What will happen to my son if he got into a car accident without a license driver in the car?

My stepson got into a car accident, He is 16 years old and only has a learner's permit. He got a ticket for not yielding the right away and driving without a license driver with him. Should we get a lawyer? I am worried what action the judge will take with him. Any advice? Thank you

Yes, he needs a lawyer. He is facing fines for each offense and a suspension of his driving privileges, in some states he would not be eligible for a license until he is 18.

Another thing that will probably happen ... the insurance company might refuse to pay claims for this accident. The fine print in most policies allows them to deny coverage if the vehicle is driven by an unlicensed driver. If the insurance company refuses to pay ... any claimants will be suing the registered owner of the car!

Driving without a license was not his best move.

You're not alone. Last year I got into a car accident where I totaled my car and cause damage to the car I hit. Like you, it was my fault and I have never had traffic violation before this episode. Thank god the person in the other car wasn't hurt. On this note, it is fair for your parents to charge you the extra fee. Not only are you responsible for your own well-being on the road, but also for the well-being of your fellow drivers. Unfortunately, it's all a part of growing up... And this is a tough lesson to be had. My insurance rate skyrocketed and now I'm paying it as well. And to be frank, when you take your car out for a drive without your parental figures in the car with you, there's no stopping you from going where you want to go. Isn't that right? You're 16... and I remember being 16. It's all about entitlement, my friend. Personally, I would be thankful your dad is still letting you drive. Your dad is trying his best to protect you and keep you safe. He's just worried it'll happen again. And it may or may not happen.

Couple years ago a young girl with a learner's permit rear ended my SUV. Fortunately, no injuries. She was cited for Careless Driving and Operating a Vehicle W/O a Licensed Driver. She was fined for the Careless Driving offense. The judge suspended her learner's permit for 90 days.

This was in Wyoming. Laws may differ in your State.

The conditions of a permit for a minor child, is very clearly documented, yes there are consequences for not driving with a licensed driver..per state laws..consult a lawyer

Your insurance company won't cover him.

The other driver can sue you for damages to his car.

The boy will have his license suspended until 21 and will have a driving violation on his record.

Your insurance premiums will sky rocket.

    You definately need a lawyer.

Always hire a lawyer, but your son is screwed, he will lose his permit and won't get his license until 18. Why did you let him drive alone, that was extremely stupid.

if you knowingly let him do that you also will get a ticket and even sued if someone was injured

you would need a lawyer because he and you are facing very stiff fines and the possibility of a very ;long suspension and even revocation of your and his driving privilege
