Military Home lease Question?

If my wife got a apartment while i was deployed so she would not have to live in army housing. I returned home and am on orders to move. the landlord said because i am not on the lease she has to pay the rent for the next 4 months of the lease she signed. Is there any way out of this?

    Your landlord is correct. You are military, and your wife is not. That she is married to a military member does not give her any protections under the SCRA. If you were also on that lease, the situation would be entirely different.

    The apartment may be in her name, but you are her husband and she is your wife... she HAS to go where ever you go as far as PCSing, SO... therefore, I think you need to talk to JAG. There should be a way out of it, orders just about get you out of everything. And if not, I would just break the lease and then not get your security deposit back. I had an apartment in my name and my husband deployed and I found out I was pregnant so I moved back home and I just broke a 12 month lease and didn't get my security deposit back. Talk to JAG and definitley talk to housing. Housing should be able to write up a letter explaining to the landlord that you are PCSing.

    I agree with the others, HOWEVER, the only way i see you may have a loop hole (and i still don't think this will work) is if she was Power of Attorney for you and signed it for you. If the apt. ran your credit score, or in any way dealt with something directly related to only you then maybe. But if your name isn't on the lease... no help for you. just figured you might be able to try that.

    No way around it. She signed a legal document agreeing to pay the full terms of the lease

    Your first-rate guess might be to speak for your landlord and provide an explanation for the challenge. They do not have got to do whatever to aid you. You could desire to seem at your hire and notice what consequences you've for breaking the hire. If the owner is having a tough time renting items then you're screwed. The faster you deliver observe the higher. However you can also lose your deposit.

    No way around it if the contract says a minimum term is required, in civvy street.
