Can we get in trouble if we don't include my wife's w2 in our tax return?

My wife didn't work much last year as she has been a stay at home mom to our 8 month old daughter. She received her W2 from the company she worked for and she made a little over $1200, yet they only took out $15 in Fed Taxes. My W2 was about $31000 earned with over $2700 in Fed Taxes. I've used a tax estimator to find out what our refund would be and adding her W2 to mine would knock over $400 off of our refund. Will/Could we get into trouble if I just "accidentally" forget to add her's? Thanks!

    Since her W2 has been sent to the IRS, you will be audited and required to pay the difference in taxes plus interest and possibly face legal issues. Doing this would be a DUMB idea!! They might not find out for a couple years, but that just means the fines and interest would be much higher.

    You FILE a return, you don't "get" one. You will get your refund BUT you must now file an amended return to correct the omission. When you get your initial refund, do NOT spend it! Prepare the amended return first to see if you owe when you file it. Many times when you omit income you will have to pay back some or even all of the original refund. You need to have that money available because you must pay it back by April 15th or you will be facing penalties and interest on top of the tax that you owe.

    Well, not in trouble exactly, you won't go to jail. But it's illegal to knowingly file a false return. And you DO have to include her W-2. If you don't, there's 100% chance of getting caught, since the IRS gets copies of ALL the W-2's issued and their computers match all of them to returns filed. It can take a year, but you'll get a bill from the IRS telling you that you didn't file that W-2 and billing you for what you owe - the original extra tax, plus penalties and interest which can be substantial by then.

    I efiled my taxes for 2014 and my ex wifes W2 info was not included. i did not catch this until after the divorce as I was going over bank statements. A refund of $1800 was direct deposited into my account and spent. Im not sure what to do. Can you help?

    you can't leave out one w2 so that you get a bigger refund. When it is caught the irs will charge you the 400 and depending on how long it takes to catch you fines and interest will add up and you will owe more than 400. It could take years for the IRS to catch but they would eventually catch it.

    Yes. The IRS also gets a copy, so if you do not report the income, they know. So if you do not include it, you'll pay all that money back, plus penalties and interest when they catch the error. And they will catch it.
