Having a gun rigged at your door, is that legal?

My auntee lives in a rougher part of town, and her neighbor had someone break in a few years back while she was sleeping and supposedly rape her (that's the rumor anyway). Nobody has been charged, and I don't think the police even have any good leads.

So now she keeps a loaded gun in front of her door at night. She doesn't have any kids or pets. If the door is forced open, it's rigged so the gun fires right at the door. She says it gives her more peace of mind, but I don't know? I definitely don't blame her, since she looks really scrawny, and no boyfriend or husband.

But is it legal?

    no thats not legal and if there not more than a foot inside your home you cant shoot them even if they forced the door open but if there not in your home you cant shoot them it is easier to do what i do get a training booby trap the type the army uses for training when it goes of it makes a loud whistle that will wake everybody up and she can this keep the gun on her night stand

    Probably not...

    And its not a good idea... think about it... She has a heart attack, and calls 911, next thing you know, she is shot by the police that are called to an EMT getting shot when they break into the door.

    If she really wants to be safe, keep the gun in the room with her.

    If someone is coming in with real malcontent, she is legally able to protect herself...

    Worse case scenario, she goes to the kitchen, and puts a butter knife in the dead guys hand before the cops get there... That is honestly what a cop told me to do when someone came in with a gun.

  • It's totally legal, and incredibly stupid to rig your home like that. If somebody comes in and is shot, she will be charged with murder. Simple as that.

    Your only defense in a case such as this is the imminent threat of death or serious bodily harm. An automatically rigged weapon relies upon simple action, no interpretation of threat. She will be charged and probably convicted.

    No, it's not legal. What if it's the cops, fire department, etc. coming through the door in an emergency?

    She should try to move to a safer area. Or get a dog.

    Boobytraps are not legal in any state that I know of. This is a boobytrap, and a pretty good one too. The reason they are illegal is because they are indiscriminate, killing or wounding anyone without regard to actually needing wounding or killing.

    If anyone were to open the door and be shot by her boobytrap, SHE would be in jail facing charges.

    I would almost be 100% sure it is illegal. If someone DID break in WITHOUT a weapon and the gun went off, she would be charged with manslaughter or attempted manslaughter. It is only self defense if the assailant entered the house with a weapon - or if they entered, attacked her, and then she pulled the gun.

    It is especially illegal if the gun is unregistered.

  • Absolutely not. People have gone to jail for that.

    Edit: Even under clearly defined conditions the verdict can vary. Self defense (deadly force) is defined: "Deadly Force may be used to fend off an attacker who is using deadly force but may not be used to repel an attacker who is not using deadly force." Tell her to load that gun with rock salt.

    It's legal to do, but if it ends up killing someone unjustifiably, then she will be charged.

    I don't believe this, because it's very difficult to rig up such a system in a house.

    Booby traps are illegal in all 50 states, if she were to kill someone she would be arrested for murder

    its hard to say because its for her protection but if someone had to bust down the door for a fire or something then they would get killed i guess it depends but im not real sure but to be postive i love her idea its awesome.
