what are the consequences for this???????can i do this??

i have three kids and would like to claim one of them as a dependent. But, my girl (not married) is recieving food stamps and medicade from all three kids and said she wasnt with me and i wasnt around in order to get them. so if i claim one of them will the irs find out or as long as no one else claims them i have nothing to worry.thanx everyone

    If you lived with the children, your girlfriend lied when applying for financial aid because she didn't include your income on the forms.

    Now you want to say, oh, I do live there, and claim them for your tax return so you can claim the exemption, EIC, etc.

    You will get questioned and asked to prove you lived there. If you do live there, the state may ask your girlfriend to pay back some of the welfare she received and she could be prosecuted for fraud. She should be prosecuted no matter what.

    She is fraudulently getting benefits if you are in fact living with her when she states you are not. The IRS as well as the Department of Agriculture ( food stamps ) and the Medicaid division are all government entities. You also cannot pick and choose which children you want to use on your taxes at will, especially if it is to add to the fraudulent activity.

    What your girlfriend is doing is illegal. If she lives with you but is telling the government she doesn't, that is fraud and she could be jailed for doing so.

    If you are living in the home with her and your children, and have provided support for the children there for more than half of the year, you are legally entitled to claim all of them. But yes, this might mess with her illegal activity. I guess it's up to you if you want to get her busted or not.

    The two of you are setting some SAD example for those poor children.

    are these your biological children? do any of them actually live with you, say how many nites do they spend with you, possibly anywhere near 183?

    if not, no you are not entitled to claim any of them unless the mother signs a #8332 waiver to allow you
