The Neighbor's Won't Let Us Stain Their Side of Our Fence ... What Can We Do?

Well, we put in a new fence. We share 95 feet of it with a neighbor being us (we're on a corner) and initially the husband was happy to have a fence going up (we all had chain link) and said he would pay his half.

The week the fence is going up the neighbor's wife bullies him out of it and they try to kill the project. We politely tell them that we will foot the bill.

Then they admit they are just renters!! They claim the owner won't allow the fence to be torn down. They give us his number.

We call and he is very nice and says it's fine with him (the owner of the property).

Fence goes up. A few weeks later we go to stain the fence and my husband knocks at the neighbor's to see if they will lock up their dog so we can get in.

The husband opens the door, cusses at him (the f-bomb!) for waking him up and slams the door in his face without giving him time to say one word. This is 11 AM.

My husband leaves a nice note for him with our phone number and the reason for his visit.

Later, we get a text. "We hate the fence. it looks tacky and blocks the view of our house. And the neighbors across the street hate it too. We hate the stain color too. We are waiting on the city to see if it's up to code." (the fence was extended from it's original line and now runs right up to their driveway).

????? They are very trashy people, so I guess we shouldn't be surprised but we have been nothing but polite! The husband even told my husband that he wants a fence because he likes to smoke weed on his back porch (and they have teenage kids!).

Now a huge portion is going to be unprotected in the weather and will decay much faster!! This is a huge investment. What can we do?

They get a free fence (which they wanted) and have the nerve to hate us for paying for the whole dang thing. And now they are going to sabotage the investment!

I've lost the owner's number or I would call him.

All I texted them back was "I'm very sorry, I thought we were in agreement about the fence. I wish we could have spoken about this before it went up. We did take our plans to the city and get a permit." NO RESPONSE.

Oh, and the fence is just inside my property line, by about 4"-5" I think.

    Use a ladder and paint roller or applicator cloth to stain the fence from your side (over the top)

    Well, sounds like a good thing you have the fence.

    Since it is wood you prob. do need to stain or paint the back side. But you are between a rock and a hard place and, assuming the renters are not going anywhere or going to change their mind, you only have two choices.

    1) FInd the owner again. Check the county tax roles and get his address and from that maybe his phone. (If you called him via a cell phone wait for the billing statement to arrive and recover it that way). If not, write him and get permission to enter HIS property and treat your fence. (ever consider painting THAT side of it Purple (grin)).

    Even better see if he will come over for an afternoon to settle things down. Some landlords will.

    2) Worst case: You will have to remove a couple of sections of board and reach thru and paint the fence from your side. bit by bit.. sorry. A ladder and long handle roller will let you do a lot of it from the top.

    You may want to consider paint rather then stain for that side since stain will only protect it for a short time and you will have to do something again.

    Usually the only thing the Police will do is come and talk to you about your dogs barking. The one you have to worry about is Animal Control and they usually give you a warning. I think they can take your dogs if there is sufficient reason. I would call Animal Control and find out what the laws are and then go from there. I had a neighbor that his dog barked continuously and I did report him. There was no reason for the dog to bark that much there was no one out there. The dog was just bored and lonely and wanted to go in the house. Animal Control didn't do much. I have had neighbor dogs that barked when I was near the fence and my dog would also, a little fence barking went on. It never bothered me. Some people look for trouble.

    Best thing to do is to get some one from the city to come out and make sure the fence is actually only on your property. "I Think" doesn't make it in these days and times. If the fence is truly on your property then you could have a problem with blocking a right of way possibly. I wouldn't be sure of that since I'm not there. However regardless of if the fence is on your property or not if you have to go on your neighbor's property to stain the fence then your neighbors have the right to deny you because you may possible have to be on their property to do the work you want to do. They could in essence complain about it being trespassing. Personally I think you really need to find the owners phone number and explain it to the owner.

    They are RENTERS. They have no say. And if it's on your property, it's your fence. Go ahead and stain it. If you have an issue with the dog, call animal control (if it's not licensed they'll be charged a nice fee to go along with it). I agree with the other answers, call the cops when they're smoking weed and get them thrown out, do you really want to be living next to these people? And, if at all possible, get in touch with the owners and fill them in on what's going on.

    The renters have no say in this. Deal with the landlord. The landlord has the right to insist that anyone doing work on his property be safe from being attacked by the dog on the property(or the tenants on the property, for that matter). Find the landlord's number. If you got it once you can get it again, even if you have to go to the land registry office and get his mailing address from them. They have to be sending the tax bill somewhere. You did everything right. The tenants are being jerks.

    If the fence is directly on the property line then both parties have a say. It really depends on whether the fence is on your actual property or theirs. Since it is on yours then I would stain it. If it was on theirs, then feasibly, you could move the fence over six inches on your side and go ahead with plans if you needed.

    You have some good answers. But you have to do a little more research. Where I live, even though I pay for the fence, the neighbor controls his side. I cannot force him to do a thing, nor can I do anything to that side. Check YOUR regulations

    Your easy out is they rent. Their landlord is where you should be going, not them.

    You either need to come up with a creative way to reach the other side of the fence while staying on your property, or you need to offer the neighbor some incentive to let you stand on his property to stain the fence on your property. It might be easier to convince them to let you over there if you let THEM choose the stain color on their side. You just want it protected. You don't care what color it is over there, so why not let them choose?
