In some states, it is illegal to bake cakes for sale at your home unless you have a commercial kitchen which has been approved by your state health department.

If you're selling cake from your own kitchen, then that's considered a home based bakery. It's illegal in some states because the bakeries (not home based bakeries, but storefront bakeries) are usually checked by the health department. Check with the laws in your own state before starting your cake business.

****If your state approve of your home based businesses, then you will need to apply for a business license. It is up to you to decide how much your cakes should cost.

Pricing, location, advertisements - it's up to you.

You need to ask a teacher or the principal if this is okay; each school district has its own rules. My guess is that it is not okay without proper adult supervision, especially for something like food which could get other people sick if it is not properly prepared and handled even if you think you are really good at baking cupcakes. There's also a chance that they won't want you doing this during school hours, because it may distract people from classes, studying, listening to the teacher, etc. Anyhow, ask the adults at your school.

If you bake them from home and not advertise - go big scale commercial then not supposed to be a problem at all for you.

You are not opening a factory, you are selling your home made baking - enjoy! anyone complaining about that must really wake up and smell the cupcakes dear!!

Unless your home kitchen has been inspected and approved by the local Public Health inspector, and you have received an approval letter, you can't sell food to the public.

So, yes it would be illegal, and you COULD end up in county court, charged under the food safety rules.

Think of something else that doesn't involve food .
