I bought a car and paid 300 back registration and I cant complete the transfer due to smof?

It failed smog and now I cant complete the transfer to my name because I need the certificate for smog in order to complete the dmv requirement to fully transfet the car to my name. My question is, can I get my money back from the dmv. They have not given me what I paid the transfer fees and registration feed for. It is not going to be put in my name because it wont pass smog. Why should they not give return my payment.
