if wife recieves inheritance while were separted still married is she required to split it(Iowa)?

my wife and i are separated but not divorced,she is expecting an inheritance from her fathers recent passing,in Iowa is she required to split it with me,i also have our son and taking care of him as well

    As the definition of legally separated may differ from state to state, you should consult an attorney in your state for specifics about this. Generally, the marital pot will consist of all assets acquired prior the date of legal separation. Meaning anything acquired after that time will not be divided by the divorce court. Not all states allow legal separation and you did not make mention if your's was a legally binding separation or just an agreement to separate until divorce. The date of legal separation is usually the date that a petition for divorce or separation is filed for divorce not the date that you physically separate. Some states will consider an inheritance separately, or not at all, even if acquired prior to date of filing. Again, you should consult an attorney in your state.

    sorry bro, inheritance is 100% her property, unless she takes the check

    and deposits it into a joint account. Iowa may be different but almost all

    states to not consider that community property, unless your name is listed

    on the will or like I said she screws up and does not keep it in a separate account.

    In Ohio, inheritance is NOT community property. Not sure about Iowa, sorry.

    You know if the tables were turned she sure as shyt would be looking to " take you to the cleaners ", right ?

    Even if you aren't legally entitled to share in the inheritance, tie it up in court and force her to make you a settlement offer.

    Dude, make your own money, get her for child support. Don't take her dead dads money. (unless she is going to blow it on drugs or something) talk to her about putting away X amount for your sons education maybe...
