if you guys have been separated for the last 6 months out of the year and separated as of 12/31/2010 then for tax purposes you would file head of a household with a qualifying child

First, there is not any filing status of "unmarried head of significant different and babies"--your preparer used head of significant different and babies because you've been separated out of your significant different. This status really labored to get you EIC because your husband wasn't on your significant different and babies from 7/a million to 12/31 2009 and wasn't on your go back. in case you at the instantaneous are back interior of a similar significant different and babies, your 2 alternatives for filing are MFJ and MFS, neither of which entitles you to EIC. the baby tax credit and extra baby tax credit are nevertheless ok.

Obligated to what? You had no right to file a joint return without his concurrence - even if he is a bum.
