How come the death penalty could be the punishment to Murder case?
Punishment is being given not because of Revenge.... Punishments will give some fear & also it helps to change the acquits mentality in prison... All punishments are being given to avoid the mistakes in future.... If the court give the death penalty to the person.... It not looks like a punishment.... The IPC section 302 should be banned forever and should give lifetime prison punishment for murder.... In terms of a very cruel kind of murderer should be punished by double or triple times... Which means... 14 * 2 times = 28 years or 14 * 3 = 42 years.... Depends upon the cruelty of Murder... Death penalty should be banned in all countries... What are your views??
Death Penalty is to cause fear in others is a good point.... But why should we give death fear to others... It looks like "If you kill any one... Then law will kill you..." By giving the strict punishment in lifetime prison do you think Is it not possible to give fear to the criminals who kill others.... Severe Emotions, Revenge makes a man to think in a cruel way.... If court also gives death penalty then what is the difference between Criminal & Law??? Law & order is to save the people not to kill others....

If it was up to me, I would not base it on the cruelty of one murder, but rather on how many people he/she has killed. Also, the death penalty is useless because most of the time, it's by injection, a painless way of death. The person will not go to heaven, nor hell because neither exists, and his brain will be active for only about 10 minutes after death. So, the death penalty brings no pain to the psyche, so I created a method which would change ones view after a few days (rehabilitation), and will give one a reason to either never commit the crime in the first place, or to never do it again. I call this method the "Synthesized Hell", named for it's incredibly inhumane treatment, fortunately, this would only apply to the worst of criminals (mass murderers, genocide creators/leaders, political assassins, etc.). When a person is sentenced to Synthesized Hell, he is locked up in solitary confinement, and given only enough food and water so that he's barely alive. Time in Synthesized Hell would be determined on the severity of the crime, from the worst, getting a life sentence, to the minor terrible, getting about 1-2 months. The effects of food and water deprivation would cause a tremendous effect on the psyche, and would be an extreme and effective form of rehabilitation, even on the most insane & stubborn of minds. PLEASE REMEMBER, THIS IS ONLY FOR THE WORST OF CRIMINALS, LIKE MASS MURDERERS WHO HAVE KILLED OVER 10 PEOPLE (They would get 1-2 months)!!!If you think this is either too much punishment or too little punishment, remember, these types of people cannot be helped by normal rehabilitation, due to their stubborn psychological wiring, and a death sentence is useless. This is a rehabilitation strong enough to attack the psyches of the stubborn criminals, and leads them to a crimeless life. It's like the retribution of god, without the immaginary beings and eternal suffering. In a country where people can be put to death from commiting 1 murder, I want to outlaw the death penalty for the people who have commited a few murders, and replace it with 40-50 years or life sentence w/ normal rehabilitation. The synthesized hell is only for those who would be considered a greater danger to the safety community or even the safety of the nation, and it is for the most stubborn of criminals. Plus, it gives time to see if they are innocent and if released because of innocence, they will get great amounts of compensation (free money from a government skrew-up. I say the Min. amount would be $700k), and wonderous programs to heal their psychological condition. It's better than death, that is true.

I disagree with you. Murder is done intentionally… so if a person knew what they are doing is wrong; (killing a person) should their punishment be JUST lifetime prison…..!! Will they realize?? Would they know the pain of loss loved one..!! … how can we be so sure that they wont make the same mistake again.?
Why you would leave a person imprisoned in jail for their lifetime… when you can punish them with death penalty…!!
But again there are difference reasons why sometimes murders are stated not wrong.
For example in the year 2008, I believe I was told to research a article for my school project regarding the book we read…. While I was searching…!!!! I saw a teen girl named Aqsa parvez was brutally murdered because she was not following her culture in abroad country. Her father that this is a disgrace and decided to take her life away… so does the father deserve a lifetime prision? Or death penalty..??
To this day, that girl is completely stranger to me…yet I have tears in my eyes every time I remember that incident…!! Its been almost 4 years..!!
Sometimes death penalties are given as a punishment for a person, so that they know the value of life…the very second before they are going to be hanged….!!! They obviously can never be forgiven…!!!
Remember the movie naan mahan alla…!! When the hero’s dad gets murdered…. Brutally…!!! The hero took it upon him to kill the murders of his dad…!! What do you think about that…?? Once a person has moved into a wrong path in their life.. Rare chances that they will once be good again…!!
Law & order saves people…… so are you agreeing that even when people do mistakes they should be saved from law.. and their punishment…??

Is it really worth arguing that a murder should not be punished though he has killed a person who was has done no harm to him… I mean… could there be a substitute for the dead person in the victim family..?? If we don’t teach the criminal what they have done is wrong…?? How will people ever know that a murder is not justice…and when committed a crime. there is no penalty…

I STRONGLY Disagree with u Balaji! Like you mentioned Law is to safegaurd the people and prevent crime and there is no need for the Law to show Mercy. Yes, Mery is virtue. In the Merchant of venice, Portia's speech on Mercy is considered to be one of the most beautiful parts of English literature. But everyone dosen't deserve Mercy. Certain crimes are considered to be brutal and so the criminals are punished accordinly. No, Law is not Revenge but people should fear someone or something and that is why Laws are there. Punishments are not given to avoid mistakes in future but are give for the mistakes commited already....
Exactly, "If you kill anyone, then Law will kill you!" No way, lifetime is prison is not enough for muderers because Murder is NOT an accident. Only accidents can be prevented in future. Don't you see, there is definately a difference between criminals and law...
Say for example: the terrorists, Paavam thirunthatum nu vitruveengala!?!? Avangaluku thirunthurathuku oru chance kudukuratha vida oru PERIYA muttal thanam irukavey mudiyathu! Punishments are punishments and they were framed with all the consequences in mind.

I am so in the middle on this subject. I know that the death penalty is wrong becasue innocent people do die from the death penalty. But then again i see such greusome murders to people that i wish the person who committed these actions to be dead. I just wish we would never have to make these choices in life. So majority rules, Americans like the death penalty as of this moment.
P.S.
I also have heard if we killed people so often for infractions in justice it would create a brutality mantality where all citizens think life is cheap and committ more crimes. I just thought that could help your arguement.

In India , execution of death Penalty is not so easy.
It has to pass through many hurdles for materialization.
It has also been seen that in many cases the death verdict gets commuted.
See in the case of Dara Singh. His death Penalty was commuted to Life Imprisonment.
Death penalty has now become nothing more than a joke. The convicts know, they will never be hanged. As such the dreaded convicts are taking benefit of such softness of Indian Laws and keep on terrorizing the society at their will.
If the rules had been strict, I believe, crime rate would never have been so high.
I also suggest that death sentence be awarded to Rape convicts also.
Think the trauma a Rape victim suffers. If some one is killed, all story is finished. But in case of Rape, the victims suffer through the whole life.
As such, I strongly support death Penalty, and also wish that the verdict be executed within a time frame, say, within a month of the final order by Supreme court.
If this happens, I am sure rate of crime will come down drastically.
If we wish to clean our society, We can not do it without harsh measures.

I am also against the death penalty; I believe murderers should be given life without parole. However I disagree with you that it is not punishment. Being executed seems to be to be the ultimate punishment. Your thought that all punishments are being given to avoid mistakes in the future is faulty (some people punish for the pure joy of punishing) but certainly the death penalty would prevent that person from committing murder in the future. Consider also that some lifers commit murder while in prison.

I believe that the death penalty will "avoid the mistakes in the future". If the criminal is dead they are not likely to do it again.
If the crime is horrendous enough why not allow the death penalty?
If the criminal is not likely to be reformed or the cost of reform to high why not?
It is not a matter of "giving death fear to others" (as you so eloquently put it) it is a matter of justice and morality. The criminal has complete disregard for the life and happiness of others, has no concept of the implications of a social contract and if allowed to live would not be capable to atone for their crimes.

Death penalty is justified only if the continuance of life of a criminal is a real threat to lives of innocent people . In India this is the case .

I thought the death penalty was justified till now. just got off the phone talking to lawyers. i wonder how many people are on death row or in jail for something they didnt do. Now on the other hand it might be the government's way of kind of controlling the population. They call it population Control
