If my husband moves out of state, and I dont know a phone number or address, can I still file for divorce?
I want a divorce desperately, but dont know how to go about it. Im hoping for full custody of my kids because he is an unfit parent. We have legally been married since 12/3/97, but havent been together since 8/1/07 when he went to prison. He was very physically and mentally abusive to me (only me never my children), cheating on me and fathering 4 children with other women during the 10 years we were together. If he hadnt went to prison I wouldnt have been able to get out alive. We have 3 children together that he's hardly seen since he's been out. He was released in 5/14/10. Hes moved constantly, living in 6 different places since he's been out, and hasnt had a job more than 2 days at a time. He has harassed me at work and home constantly. He has beaten up his girlfriend in front of my kids. Hes involved my daughter in helping him sell stolen property. He has finally moved out of state, but refuses to give me or the kids his phone number or address. I have lived in the same home since we split and have held the same job. My kids have always lived with me. I dont know what I should do. I always believed that I have to have his address to file. I hope someone can help me with this problem.

Yes you can. You (or your attorney) would have to make a good faith effort to find him to serve him with court papers. If that was unsuccessful, he can be served by publication which means putting a legal ad in the newspaper where he is most likely to see it. After that you are good to go.

Consult a Lawyer and the courts, the system should be there to help people in your situation. I dont see why you havnt done this long ago, protect your family and cut him loose. good luck

the divorce is between you and the court, not between you and him...just file claiming abandonment, give them his ss number...they will locate him and serve him wherever he is....good luck
