Can a school discuss one students medical status with another student?

I have two boys one in elementary and one in High school. My younger son had an illness and the high school nurse pulled my older son from class to discuss that illness (under doctors care) and wanted him to give her all and any information he had about his younger brother. Instead of contacting me or my husband. Is this against the law? Is this wrong to anyone else?

Update:

The school had notification of illness and my younger sons ok to be in school. My older son was not only questioned but told to "avoid" his little brother. Even though his brother was given the all clear by his pediatrician and the school new this.

Why would CPS need to be called that's just dumb?

    Not illegal, but should have called CPS if suspicious of what was going on.

    HIPPA only protects a select group of conditions, all of which I'm willing to bet your son doesn't have thus it's not a violation. As long as his conditions weren't serious, it was just an ethical mistake and there's no recourse.

    HIPPA conditions that get protection are like serious STDS, cancer, things of that nature where people finding out could be devastating.

    I've taken 2 classes on HIPPA law - I know more about it then anyone here FYI for whoever gave the thumbs down. People read the general definition of HIPPA and assume it can be applied vastly, not the case.

  • It's not illegal, but you should contact the nurse and ask that future contact be directly with you. It's perfectly natural to ask someone who presumably knows the situation and who is at hand.

    Think it through: if the HS nurse found out that the younger boy had a highly contagious disease, it would be natural for her to check with the older boy about the situation and his own contact.

    Yes it's wrong.

    I'm sure the Nurse was in a hurry and had the best intentions, however, but that was still wrong.

    I do believe it is a HIPAA violation....
