is it legal to tape record phone call with mortgage company?

I called them today and i wanted to tape record conversation because they have been overcharging and giving late feed on payments i have proof i payed before due date i told the employee i was tape recording and then the employee refused does he have legal right to refuse im in florida and during the beginning of conversation they played a recording stating they may or may not record this call i have heard that gives me the right to also record the call if you can hear recorded statement on tape

    you do not need a lawyer you advised him the call was being recorded, if he refused to talk then you hang up, you can not continue to record if they say no.

    it works the same way when you call and the disclaimer says this call may recorded, you are free to hang up

    I would recommend calling a lawyers office and find out what the laws are in your state on recording phone conversations. Some states allow it if one party is aware (meaning if you know it's being recorded but they don't, or vise versa, it's okay) where some states require both party's be informed of the recording. A lawyer should be able to give you the information free over the phone as to what the laws are in your state.
