Can an arrest for domestic violence affect child custody decisions?

Can a domestic violence arrest and charge have an affect on a child custody case, if it was a step parent who was in violation? Can a parent lose custody if he/she refused to testify against this person even if there is a record of this happening?

Update:

It was the step father against the mother of her children by her ex husband. Sorry I wasn't clear.

    Yes it can. Domestic violence isn't usually a one shot deal...Judges and Attorney's know that. By the time it gets to the arrest state - it's already gone from verbal to physical...abusers adhere to patterns of abuse...DV is the culmination of it.

    Of course.

    You said it was a step parent, but you did not mention who was involved. If it was your child, and your new husband (step-parent) was violent with with him and he told

    his bio father. OMG.... sure, he might (and should) go for custody. I know I would.

    If it was your child and your spouse was violent with one of your kids and you failed

    to testify against him, you are just as guilty as he is and should definitely lose custody.
