Neighbour dispute...?

My Neighbour built a detached garage right up against the property line between our houses. He built it beneath a tree that is plants just on my side of the property line. He is now claiming that this tree is causing moss to grow on his garage roof shingles and that I need to cut it down. I don't want to cut it down because it's the only thing that blacks any view of his stupid garage. I understand he can trim any branches that cross the property line, but that won't solve the shade problem. Is it legit to tell him to move his damn garage, because the tree was there first!

    I would check the zoning laws in your town...most zoning laws don't permit a structure to be built right against the property line...they usually specify an "offset" of at least three feet...If the garage is in violation, you can contact the town and they will make him tear it down.

    Its your tree.. you do not have to cut it down. Tell him he should have planned for the moss issue when he built the garage.

    Neither can you tell him to move the garage.. (lets not be childish now).. He is stuck with the problem and the solution is HIS not yours.

    (Just watch out for copper nails in the tree or something like that).
