Is wiki breaking US law?

I read an earlier question about the wiki page showing the scorpions virgin killer album of a naked 10 year old girl.

Is wiki breaking US law for posting that? Do americans viewing that image get in trouble as well?

    Based on the description of the image you provided, that is not child pornography.

    Even if it is a head-to-toe image and she is wearing nothing, that does not meet the criteria.
