Virginia Reckless Driving Charge?
I recently received a Reckless Driving Charge while on a road trip in VA.
The officer "clocked" me at 79/55. I don't think that's what I was doing, but
I know I can't fight a radar gun in court. I was surprised however to find that
what a simple speeding ticket would be in Maryland is Reckless Driving in VA!
I called a lawyer and can not afford to hiring one... however, from their advise I know
to bring a copy of my clean driving record, get my speedometer calibrated, and hope for the best.
However, I was wondering if you can offer me any advise as how to get this charge
greatly reduced (hopefully to something without points)
I don't know if this information helps, but my guages sometimes don't work,
RPM never...
and the officer who issued me the court summons wrote both my
address and license plate number incorrectly on the ticket.. is that
some wort of technicality I can use?
I just don't want a 6 point ticket and a 2500 dollar fine... please help!?!?!?!?!

Yes, $2,500 fine is the maximum legal fine, but there's no way you'll be fined even half that much. I've reviewed hundreds of DMV and criminal records, usually the most I've seen for reckless driving is s $250 fine and never any jail time.

Reckless utilising, however if the cost is according to intense speed or consequences from an accident, is a criminal offense in Virginia. there are multiple out of state drivers and a few Virginia drivers who're very much shocked to earnings vacationing on a street at 80 one miles according to hour in a 70 mile according to hour zone may well be charged as reckless utilising. decrease than this particular condition, a guy or woman would extremely be charged with reckless utilising for going 11 miles over the published speed decrease.

Just get a good lawyer. Yes, you can use the information that he wrote wrong in your favor. However, I don't understand what other information I can give you. If you are going to court already, then the best advice is to talk to your lawyer. As far as your gauges, that might be a mitigating factor, but you are required in most states to keep your speedometer functioning, so more than likely it will be deemed your fault for not completing the maintenance on the gauges.
PS: I don't know that going 24 mph over the speed limit would be a simple ticket anywhere unless the officer was nice and fudged the speed in your favor.

Address & license plate info can & will be amended before court.
Source(s): I am a retired police officer. I retired as a sergeant, after 29 years, from a very large department, about 12,000 officers. I was a patrol officer for 4 years in a very diverse area. I was a tactical officer in the high rise project areas of my city. We called it vertical patrol in that we walked the the stairways of the high rises most of the time. I did that for 5 years and was promoted by test to detective. I worked violent crime (homicide, sex, officer involved shootings, robbery, kidnapping, serious non property incidents) for 11 years until I was promoted to sergeant. I worked as a street supervisor, a bicycle patrol supervisor and a desk sergeant/watch commander. During my time as a tactical officer and a detective I was a unit representative for the police union. I have a B.A in English and an M.S. in Law Enforcement Administration..
