has anyone ever heard of ICE releasig a illegal who overstayed on the visa waiver program?

my husband has been detained by ICE for overstaying his visa he entered on the visa waiver program and overstayed. we have 3 yr old triplets, one with severe medical problems and one with special needs. he hasnt been convicted of any crime in the usa, he is being held because they found out he overstayed. is there any hope for us?

Update:

i didnt adjust his status because i became pregnant with the triplets and then spent months in various hospitals trying to save my daughters life. she is going to need a new heart and god i wish i had adjusted his status, because now im in a living nitemare that looks like it will not turn out good. ive contacted an immigration lawyer they are trying their best, but we just dont know, the law is the law and now my family is being torn apart. thanks everyone for their feed back

    He will get choice of either getting deported or voluntarily depart from US. He is not going to get released to you at all. Especially if you are US Citizen or US Permanent Resident, they know that he has chance to get immigrant visa (green card) sponsored by you.

    Get a lawyer NOW. There are specific loopholes for people in his circumstance. Without a lawyer they will not release him.

    Why in the world did you not file to adjust his status? This all could have been prevented. Now you have got a real mess on your hands an need the help of an immigration lawyer.

    The law is clear.He'll be deported for over staying and be banned from coming back for a specified time.What could be worse for his family is ICE may decide to investigate and knock on your door.My suggestion,if possible,is find a sympathetic lawyer who may be able to help him.
