why can i still smell cigarette smoke coming through my HVAC air vents!?

i have a central air system. and my father smokes but he doesnt smoke inside he smokes in the garage where the hvac unit and filter thing is located. i live in a 2 story home. and whenever my father decided to smoke i can smell it strong in my bedroom and the smell comes from the air vent. wondering if the filter is not doing its job. or what other reason it could be!?

Tell you father to chose a different place for smoking not the HVAC unit area or the air filter area, the air filter does not stop smoke but stop dirt's into your HVAC unit from circulating into the home, do not bring any flammable such as fire, petrol etc into your furnace or heating mechanical room, good luck. Real estate transactions in most states, both rental and sale, require "full disclosure" of all known existing conditions. Your landlord, the lawyer, should have known that. The fact that there are vents from a smoker's apartment directly into yours is a known condition that should have been disclosed in the contract. In my opinion your lease can be broken on the grounds that you were not informed of a known condition that renders the property unsuitable for your use. That won't help you too much as far a place to live ... but at least you should not have to honor your contract with the landlord! I'm a smoker [my bad, I know the risks and realize that it will probably kill me], but I recognize that some people are very sensitive to smoke! I rent an apartment, and smoke outside to help minimize the problems others might suffer! When I travel with family [some of my family has problems with smoke] I usually drive my own (smoker's) car ... no reason to cause others harm for MY bad choice! Your landlord is a lawyer, and probably pretty savvy about real estate law! You need a lawyer too! I predict that the landlord will "let you out of your lease willingly" rather than push for a civil trial. Good luck! Hopefully the landlord will be a decent guy and let you out of the lease without too much trouble!

maybe there is a louver that is set for fresh air usually 10% fresh air and when your father smokes next to the unit the fan is bringing it in.

As for the filter, it will not stop the smell only particles, but you can buy one that is filled will charcol.

Most likely there are leaks around the return air, this is dead space under the a\c unit. The return air pulls air in, and will pull the cig smoke into the home as well.
