In Mi. what is the legal age for a child to choose who they live with after a divorce?
My son is fighting for full custody of the children but his soon to be ex wife says the kids can choose who they want to live with. She left him and the kids for another man but is living in the family home until the divorce is final, The kids are 9 & 11.

The court always has the authority over where custody resides. The children never get to choose. At around age 12 or so the court will usually listen to the wishes of the children but it doesn't necessarily follow that the court will give them what they say they want. The best thing your son can do is ask the court for custody in his filings and request a family evaluation of both homes by the court.

18, minor children never have final say. The court however will consider their desires when deciding custody.

It is 18 years of age. So, they cannot legally do it until they are an adult.
