Dwi misdemeanor in Texas, first offense. Jail time?

If someone just had their first offense dwi with no other convictions, could they REALISTICALLY have to serve jail time after the initial arrest? We don't know what the BAC is yet...haven't gotten the blood test results back yet. No accident our injuries.

I know its still a very very big, expensive deal. Also, assuming the license is automatically revoked, and a work waiver type license is allowed, can it be issued right away? Like right after the 41 day provisional temp license expires?

I'm not sure what the laws are like in Texas, but in Indiana it's almost impossible to get a work license. You may have to spend a weekend or two in jail. It's up to the judge's discretion when sentencing.

It depends on your state. In my state there is mandatory jail time for DWI regardless if it is your first or fifth.
