I understand that the military has there own list of what they consider to be a felony?

could someone tell me if Felony Criminal Mischief would be considered a felony to the army?

    Which part of "FELONY" would you think the Army would consider not to be a felony?

    If you are charged with Felony Criminal Mischief, then you stand trial in civilian court. When that is done, then the military can decide to charge you or not. One thing they like to charge you with if you are guilty and have to miss any time from your military service for it is Article 86. And they could also hit you up on an Article 134 charge as well.

    The UCMJ doesn't define crimes in categories in that way. If a crime is a felony by state or national law, you've committed a felony. You'll be charged by the court as well as by the UCMJ. It's even worse in a foreign country if you break one of their laws.
