Not getting payed overtime for hours worked. Is this legal?
the company I work for pays half of their employees hourly rate for any hours over 40. They call this pay method "Flex Pay". I was under the impression that under Louisiana state law, employers were obligated to pay overtime after 40 hours.

Louisiana does NOT require the payment of overtime

if the business you work for is not covered by federal law (FLSA) then what they are doing is legal

Calvin simply does NOT know how the law works, federal labor law (FLSA) only covers certain businesses. it does NOT cover MOST small businesses unless they are involved in interstate commerce

Louisiana does not have its own laws relating to overtime etc., it adheres to federal law only. You must be paid 1.5 times base pay for all hours over 40 hours unless you work in the hospitality industry unless you are salaried and then your salary must be high enough to cover minimum wage and overtime up to 50 hours per week with overtime after 50 hours. Flex pay time off is only legal for government agencies
