Legally, that's property damage. The first step would be to tell him the situation and see if he offers to replace the plants. If not, you can threaten to take him to small claims court and he will most likely pay for the plants to save himself the hassle. If he still doesn't cooperate you really can take him to small claims court if you have proof that the plants were there before.

Well call him back and ask him why he did it - and make him pay for new ones. I awesome that his business has insurance, if he does not cooperate get a police report. and then try to get from his insurance company.

Our Gardener has insurance and i asked him were he is insured with he told me Prime Insurance Agency. He told it is expensive every business owner in this case the Gardner has to have Insurance.

CAPS ARE REALLY HARD TO READ...COMMUNICATION IS KEY HERE, I DON'T KNOW WHAT HE WAS THINKING OR WHAT HE THOUGHT THEY WERE OR MAYBE HE HAS A PERSON WORKING WITH HIM THAT IS CLUELESS BUT YOU WILL NEVER KNOW UNLESS YOU TALK TO HIM AND FIND OUT WHAT HAPPENED AND THEN ASK HIM TO REPLACE THE PLANTS. A MISTAKE IS A MISTAKE AND THERE IS LITTLE IF ANY LEGALITY TO IT.

I hate when that happens. He probably didn't do it deliberately. I'm just saying, I don't know for sure. It could have been an accident or mistake on his part. Talk to him and ask him to replace them.

Sounds like a very bad landscaper! Why would he take them out and throw them anyways?
